General terms and conditions of sale

  1. Scope: These General Terms and Conditions of Sale (GTC) apply to all sales of JIYU guitars made between JIYU and its customers as part of its commercial activity. They prevail over any other document or agreement exchanged between the parties.
  2. Orders: Orders for JIYU guitars can be placed through our website or any other authorized means of communication. Any order is firm and final upon receipt of the deposit or full payment of the order. We reserve the right to refuse any order in case of non-payment, suspicion of fraud, or unavailability of products.
  3. Prices and Payment: The prices of JIYU guitars are listed in euros, including all taxes on the website. Shipping costs are charged in addition unless stated otherwise. Payment for orders can be made by credit card, bank transfer, or any other payment method accepted by JIYU. Payments must be made in full before the products are shipped. For custom instrument orders, a 50% deposit of the total price is required. The remaining amount is to be paid upon handover of the instrument or before shipment in the case of a delivery. Deposits are non-refundable if the buyer withdraws after the quote has been signed.
  4. Delivery: JIYU guitars are delivered to the address provided by the customer at the time of ordering. Delivery times are indicative and may vary depending on product availability and logistical constraints. JIYU is committed to making reasonable efforts to meet the announced delivery times but cannot be held responsible for delays beyond its control. In the event of shipment, JIYU cannot be held liable if the information provided by the customer regarding the recipient’s details is incorrect or incomplete.
  5. Right of Withdrawal: In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of goods made to the consumer’s specifications or clearly personalized. Therefore, any order for a custom-made instrument, including any request for specifications or personalization by the customer at the time of ordering, is not eligible for return or refund. For generic instruments, i.e., not custom-made, the customer has fourteen (14) days from the receipt of the JIYU guitar to exercise their right of withdrawal, without having to provide reasons or incur penalties. The customer must notify their withdrawal in writing to JIYU and return the guitar in its original packaging, in perfect condition, along with all provided accessories. Return shipping costs are the customer’s responsibility.
  6. Warranty: JIYU guitars are covered by a legal warranty of conformity and a legal warranty against hidden defects, in accordance with the provisions of the French Civil Code. In case of non-conformity or hidden defects, the customer can exercise their rights by contacting JIYU. The warranty does not cover damage resulting from improper use, negligence, or unauthorized modification of the instrument (breakage, shocks, exposure to heat sources, exposure to moisture, scratches).
  7. Personal Data Protection: Personal data collected during the order process are necessary for processing the order and commercial management. They are processed in accordance with applicable data protection regulations. You have the right to access, correct, and delete your data.
  8. Intellectual Property: All intellectual property rights related to JIYU guitars, including designs, models, trademarks, logos, and any other protected elements, remain the exclusive property of JIYU. Any unauthorized reproduction, imitation, or use is strictly prohibited.
  9. Liability: JIYU disclaims any liability for direct, indirect damages, accidents, or harm resulting from the use of JIYU guitars. The customer is responsible for the proper and safe use of the instrument, in accordance with the recommendations provided by JIYU.
  10. Force Majeure: JIYU cannot be held responsible for any delay or failure to perform its obligations due to a force majeure event as defined by French law. Force majeure events will suspend contractual obligations for the duration of their existence.
  11. Disputes: In the event of a dispute or claim related to the sale of JIYU guitars, the parties will strive to resolve their differences amicably. Failing an agreement, any dispute will be submitted to the exclusive jurisdiction of the courts competent for the location of JIYU’s registered office, in accordance with applicable French law.
  12. Modification of GTC: JIYU reserves the right to modify these General Terms and Conditions of Sale at any time without prior notice. The applicable GTC are those in effect at the time of the order.
